DishUp provides digital visual menu services that allow restaurants and food businesses to display their menus online using photos and categories accessible via QR codes.
This Agreement outlines your rights, responsibilities, and limitations when using DishUp.
2. Eligibility
To use our services, you must:
- Be at least 18 years old,
- Be authorized to act on behalf of a business (restaurant or similar entity),
- Provide accurate information during registration.
3. Account Registration
When creating an account, you agree to:
- Provide accurate, current, and complete information,
- Keep your credentials secure,
- Be responsible for all activities under your account.
DishUp reserves the right to suspend or terminate accounts for misuse, fraud, or violation of these Terms.
4. Service Plans & Payments
- DishUp offers subscription-based plans (monthly or annual).
- Fees are displayed on the pricing page and may change with prior notice.
- Payments are processed securely via third-party gateways (e.g., Stripe or PayPal).
- Subscriptions renew automatically unless canceled before the next billing cycle.
- You may cancel anytime via your account dashboard or by contacting billing@dishupmenu.com.
No refunds are provided for partial billing periods or unused time.
5. Use of Service
You agree not to:
- Use DishUp for illegal or unauthorized purposes,
- Upload offensive, harmful, or copyrighted material without rights,
- Interfere with site operation or security,
- Reverse engineer or copy DishUp’s code or systems.
Violation may result in suspension or termination of your account.
6. Intellectual Property
All content, software, designs, logos, and trademarks on DishUp are owned by DishUp or its licensors and protected by U.S. and international copyright laws.
You are granted a limited, non-exclusive, non-transferable license to use the service solely for your restaurant’s operations.
You may not reproduce, resell, or redistribute our platform or designs.
7. Content Ownership (Your Data)
You retain ownership of all images, text, and menu content uploaded to your account.
By submitting content, you grant DishUp a non-exclusive, royalty-free license to display and operate that content as part of your restaurant’s menu.
You are responsible for ensuring that all submitted content complies with copyright and does not violate third-party rights.
8. Availability & Maintenance
We strive to keep DishUp available 24/7, but occasional downtime may occur for maintenance or upgrades.
DishUp is not liable for interruptions, delays, or loss of data caused by technical issues, internet failures, or third-party providers.
9. Disclaimers
DishUp provides the service “as is” and “as available.”
We make no warranties, express or implied, including:
- Fitness for a particular purpose,
- Continuous availability,
- Accuracy or completeness of content.
Use of the platform is at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law, DishUp and its affiliates shall not be liable for:
- Any indirect, incidental, or consequential damages,
- Lost profits or data,
- Service interruption or loss of business opportunity.
In any case, DishUp’s total liability shall not exceed the amount you paid in the previous 12 months.
11. Indemnification
You agree to indemnify and hold harmless DishUp, its officers, employees, and affiliates from any claims, damages, or expenses arising from:
- Your use of the platform,
- Violation of these Terms,
- Infringement of intellectual property or privacy rights.
12. Third-Party Services
DishUp may integrate with or link to third-party tools (such as Google Analytics, Twilio, Stripe, etc.).
We are not responsible for their policies, security, or performance.

13. Termination
You may terminate your account at any time.
DishUp reserves the right to suspend or terminate accounts for:
- Violation of these Terms,
- Fraudulent or abusive behavior,
- Non-payment.
After termination, your access to the dashboard and uploaded data may be permanently deleted.
14. Changes to These Terms
We may update these Terms at any time.
When changes are made, we will post a new “Last Updated” date.
Continued use of DishUp after updates constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles.
Any disputes shall be resolved in the state or federal courts located in Fulton County, Georgia.
